DECISION & ORDER ON MOTION

Appeal from an amended order of the Supreme Court, Kings County, dated May 23, 2023. Motion by the nonparty-respondent Parkville Realty Association LLC to dismiss the appeal on the ground that the right of direct appeal from the order terminated upon entry in the above-entitled action of an amended judgment of the same court dated October 3, 2023. Motion by respondent-respondent to extend the time to serve and file a brief.

Upon the papers filed in support of the motion by respondent Parkville Realty Association Inc. and the papers filed in relation thereto, and upon the papers filed in support of the motion by respondent-respondent and the papers filed in opposition thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements (see Matter of Aho, 39 NY2d 241); and it is further,

ORDERED that the motion to extend the time to serve and file a brief is denied as academic.
