Motion by appellant for summary reversal on an appeal from a judgment of the District Court of Suffolk County, Traffic and Parking Violations Agency, entered September 19, 2023.
Upon the papers filed in support of the motion and the papers filed in response thereto, it is
ORDERED that the motion is granted, the judgment entered September 19, 2023 is summarily reversed, without costs, and the notice of liability is dismissed.
The People consent to the relief requested in appellant's motion in light of this court's decision in People v Croce (81 Misc 3d 31 [App Term, 2d Dept, 9th & 10th Jud Dists 2023]).
