Appeal from an order of the Supreme Court, Queens County, dated December 23, 2022. Motion by the respondent A & E Real Estate Holdings, LLC to impose a sanction upon the appellant for filing a frivolous appeal. Motion by the appellant to compel discovery of certain material.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion by the respondent A & E Real Estate Holdings, LLC is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that the motion by the appellant is denied.
