DECISION & ORDER ON MOTION

Appeal by Francisco Nival from an order of the Family Court, Westchester County, dated June 16, 2023. By decision and order on motion of this Court dated April 15, 2024, the appellant's time to perfect the appeal was extended until May 13, 2024. The appellant has failed to perfect the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs of disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.3[b][2]) and prior order of the Court.
