Appeals from three orders of the Supreme Court, Kings County, dated September 30, 2022, September 22, 2022, and May 3, 2023, and an order and judgment (one paper) of the same court dated May 3, 2023, respectively. Motion by the appellant to stay the sale of the subject property, pending hearing and determination of the appeals, in effect, to consolidate the appeals from the orders dated September 30, 2022, and September 22, 2022, with the appeals from the order and the order and judgment, both dated May 3, 2023, to deem the record and briefs filed in connection with the appeals from the orders dated September 30, 2022, and September 22, 2022, also to be filed in connection with the appeals from the order and the order and judgment, both dated May 3, 2023, and for leave to file a supplemental record containing certain material. Separate motion by the appellant to extend the time to perfect the appeals from the order and the order and judgment, both dated May 3, 2023.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay the sale of the subject property is denied; and it is further,
ORDERED that the motion to extend the time to perfect the appeals from the order and the order and judgment, both dated May 3, 2023, and the branches of the motion which are, in effect, to consolidate the appeals from the orders dated September 30, 2022, and September 22, 2022, with the appeals from the order and the order and judgment, both dated May 3, 2023, to deem the record and briefs filed in connection with the appeals from the orders dated September 30, 2022, and September 22, 2022, also to be filed in connection with the appeals from the order and the order and judgment, both dated May 3, 2023, and for leave to file a supplemental record containing certain material are granted, the appeals from the orders dated September 30, 2022, and September 22, 2022, are consolidated with the appeals from the order and the order and judgment, both dated May 3, 2023, the record and briefs filed in connection with the appeals from the orders dated September 30, 2022, and September 22, 2022, are deemed also to be filed in connection with the appeals from the order and the order and judgment, both dated May 3, 2023, on or before August 14, 2024, the parties shall serve and file, via NYSCEF, replacement briefs which contain Appellate Division Docket Nos. 2023-07212 and 2023-07214 in addition to Appellate Division Docket Nos. 2022-10255 and 2022-10257 on the covers, and the appellant shall serve and file, via NYSCEF, a replacement record which contains the order and the order and judgment, both dated May 3, 2023 and the notice of appeal from the order and the order and judgment, both dated May 3, 2023, and Appellate Division Docket Nos. 2023-07212 and 2023-07214 in addition to Appellate Division Docket Nos. 2022-10255 and 2022-10257 on the cover.
