DECISION & ORDER ON MOTION

2024-06120

Somnauth Dyaram, respondent,

v Janine Gordon, et al., appellants.

(Index No. 56724/2023)

Appeals from two orders of the Supreme Court, Westchester County, dated March 12, 2024, and March 15, 2024, respectively.

On the Court's own motion, it is

ORDERED that the appeal from the order dated March 12, 2024, is dismissed, without costs or disbursements, on the ground that no appeal lies from an order entered upon the default of the appealing party (see CPLR 5511); and it is further,

ORDERED that the appeal from the order dated March 15, 2024, is dismissed, without costs or disbursements, on the ground that the order is not appealable as of right (see CPLR 5701), and we decline to grant leave to appeal.

BRATHWAITE NELSON, J.P., WOOTEN, VENTURA and LOVE, JJ., concur.
