Respondent having moved to dismiss the appeal taken herein from a judgment of the Supreme Court, Orleans County, rendered January 3, 2024, on the ground that appellant has failed to timely perfect the appeal,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the notice of appeal filed in the Orleans County Clerk's Office on January 8, 2024, which lists the SCI number as 23-S-20, shall be treated as valid as to SCI number 70145-23/001, pursuant to CPL 460.10 (6), and
It is further ORDERED that the motion is granted, and the appeal is dismissed without further order unless perfected on or before September 27, 2024.
