Appeal from an order of the Supreme Court, Richmond County, dated October 7, 2021, which was determined by opinion and order of this Court dated April 24, 2024. Motion by the appellant for leave to appeal to the Court of Appeals from the opinion and order and to stay the trial in the above-entitled action, pending hearing and determination of the motion and pending determination of an appeal by the Court of Appeals, should leave to appeal to that Court be granted.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to the Court of Appeals is denied; and it is further,
