DECISION & ORDER ON MOTION

MJT Metro, LLC, Respondent, v Teresa K. Szymanik, Appellant, et al., Undertenants.

Motion by appellant for an extension of time to perfect an appeal from a decision of the Civil Court of the City of New York, Queens County, dated November 12, 2020. Separate motion by appellant to stay the execution of a warrant of eviction pending the determination of the appeal.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that the motions are consolidated for purposes of disposition; and it is further,

ORDERED that the motions are granted on condition that the appeal be perfected on or before September 27, 2024; and it is further,

ORDERED that in the event the appeal is not perfected by September 27, 2024 the court, on its own motion, may dismiss the appeal or vacate the stay, or respondent may move, on three days' notice, to dismiss the appeal or vacate the stay, and may serve such application upon appellant in person; and it is further,

ORDERED that no further enlargements will be entertained as this court is aware that the Civil Court ordered the court file's reconstruction on January 5, 2023.
