| DECISION & ORDER ON MOTION |
Appeals from an order of the Supreme Court, Westchester County, dated July 9, 2024. Motion by the appellant John U. to stay enforcement of the order and direct that the parties abide by the terms of an order of the Supreme Court, Westchester County, dated August 21, 2023, pending hearing and determination of the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the motion is granted to the extent that so much of the order as modified the regular, summer, and holiday access schedules to limit the appellant John U.'s right to visitation with the nonparty-appellant A.U. to a maximum of two visits per week, no longer than two hours each, which shall occur in Westchester County and be supervised by a court-appointed therapeutic access supervisor with reports to be issued to the Supreme Court, Westchester County, the cost of which shall be paid solely by the appellant John U. and terminating the appellant John U.'s telephone access with the nonparty-appellant A.U. is stayed, and the parties shall abide by the parenting time schedule and parenting time terms set forth in the parenting agreement dated September 11, 2020, as modified by the stipulation of settlement dated November 13, 2020, which was incorporated, but not merged, into the judgment of divorce entered January 12, 2021, pending hearing and determination of the appeals.
