| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Queens County, dated July 14, 2023. By order to show cause dated October 30, 2023, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the appellant is not aggrieved (see CPLR 5511). By decision and order on motion of this Court dated December 20, 2023, the motion was held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof. The appellant has not perfected the appeal, and the appeal has been deemed dismissed pursuant to 22 NYCRR 1250.10(a).
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion is denied as academic.
CONNOLLY, J.P., MILLER, FORD and WAN, JJ., concur.
