DECISION & ORDER ON MOTION

Motion by Dennis Steven Berkowsky for reinstatement to the Bar as an attorney and counselor-at-law. Berkowsky was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 29, 1981. By opinion and order of this Court dated March 18, 2015, Berkowsky was disbarred based on his conviction of a felony and his name was stricken from the roll of attorneys and counselors-at-law, effective August 10, 2011 (see Matter of Berkowsky, 127 AD3d 175). By decision and order on motion of this Court dated January 15, 2021, Berkowsky's first motion for reinstatement was denied. By decision and order on motion of this Court dated December 21, 2022, Berkowsky's second motion for reinstatement was held in abeyance and the matter was referred to a Committee on Character and Fitness to investigate and report on Berkowsky's character and general fitness to practice law. Application by Berkowsky to withdraw his second motion for reinstatement.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted, the decision and order on motion of this Court dated December 21, 2022, is recalled and vacated, and the second motion for reinstatement to the Bar as an attorney and counselor-at-law is deemed withdrawn.
