| DECISION & ORDER ON MOTION |
The respondent was admitted to the Bar in the State of New York at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 26, 2006. By order to show cause dated November 15, 2022, this Court directed the respondent to show cause why an order should not be made and entered pursuant to 22 NYCRR 1240.13 imposing discipline upon him for the misconduct underlying the discipline imposed by an order of the Supreme Court of the State of Minnesota filed July 13, 2022. By opinion and order of this Court dated July 10, 2024, the respondent was suspended from the practice of law for a period of six months, commencing August 12, 2024, based upon the discipline imposed by the Supreme Court of the State of Minnesota.
On the Court's own motion, it is
ORDERED that the opinion and order of this Court dated July 10, 2024, is recalled and vacated, and the above-entitled disciplinary proceeding is discontinued, in view of the death of the respondent on November 5, 2022.
