Proceeding pursuant to CPLR article 78 in the nature of mandamus to compel the respondent Maurice E. Muir, a Justice of the Supreme Court, Queens County, to determine a motion in an action entitled Lycan Capital Fund I, LLC v Barnes, pending in that court under Index No. 702129/2013.
On the Court's own motion, it is
ORDERED that the proceeding is dismissed, without costs or disbursements, for failure to pay the filing fee (see CPLR 8022[b]; 22 NYCRR 1250.17[a][1]).
