Motion by appellant for a stay of a decision of the District Court of Suffolk County, Sixth District, dated August 29, 2024, pending the determination of an appeal from that order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion for a stay is granted.
To the extent appellant also seeks "an order . . . [p]ermitting [appellant] to file, with a court of appropriate jurisdiction, an action declaring [petitioner] maintains no enforceable rights under the lease which is the subject of this action," such relief is not appropriate for this court to grant or deny. It is noted, however, that it appears that appellant has already commenced such an action.
