| DECISION & ORDER ON MOTION |
Appeals from two orders of the Supreme Court, Queens County, dated July 10, 2023, and October 13, 2023, respectively. By order to show cause dated November 29, 2023, the appellant was directed to show cause before this Court why an order should not be made and entered dismissing the appeals on the ground that the orders are not appealable as of right and leave to appeal has not been granted (see CPL 450.10, 450.15). By decision and order on motion of this Court dated March 18, 2024, the application by the appellant, in effect, pursuant to CPL 460.30 for an extension of time to make a make an application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the orders was granted and the motion to dismiss the appeal was held in abeyance in the interim. By decision and order on application of this Court dated April 19, 2024, the application by the appellant pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the orders was denied. By decision and order on motion of this Court dated July 22, 2024, the motion by the appellant for leave to reargue his prior application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the orders was denied. Motion by the appellant for leave to appeal to the Court of Appeals from the decision and order on application of this Court dated April 19, 2024, and the decision and order on motion of this Court dated July 22, 2024.
Now, upon the order to show cause and the papers filed in response thereto and upon the motion by the appellant and the papers filed in opposition thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal purportedly taken as of right is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion for leave to appeal to the Court of Appeals from the decision and order on application of this Court dated April 19, 2024, and the decision and order on motion of this Court dated July 22, 2024, is denied (see CPL 450.90).
