DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Kings County, dated February 16, 2022. Motion by the appellant to be provided with the transcript of the grand jury proceedings.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted to the extent that on or before December 18, 2024, the respondent shall provide counsel for the appellant with a copy of the transcript of the minutes of the testimonial portions of the grand jury proceedings, the appellant's attorney shall keep the transcript confidential, and shall not disclose the contents of the transcript to anyone, except in the appellant's brief, which shall be marked confidential and may not be viewed by the public but may be viewed by counsel for the parties, or representatives of counsel, authorized, in writing, to view the respondents' briefs, and the motion is otherwise denied; and it is further,

ORDERED that on the Court's own motion, the appellant's brief, the respondent's brief, and the appellant's reply brief, if any, shall be marked confidential, and the appellant's brief, the respondent's brief, and the appellant's reply brief may not be viewed by the public but may be viewed by counsel for the parties, or representatives of counsel, authorized, in writing, to view the appellant's brief, the respondent's brief, and the appellant's reply brief.
