| ORDER TO SHOW CAUSE |
Appeal from an order of the Supreme Court, Queens County, dated October 29, 2021. The appellant perfected the appeal on August 15, 2022, the respondents filed a brief on November 8, 2022, and the appellant filed a reply brief on November 28, 2022. The matter was placed on the calendar for November 15, 2024. On October 30, 2024, the appellant and the respondent submitted a stipulation withdrawing the appeal. Documentation was submitted to this Court with the stipulation indicating that the parties had reached a settlement of the above-entitled action on or about February 7, 2023, which was approved by the Supreme Court, Queens County on August 24, 2023.
Now, on the Court's own motion, it is
ORDERED that Adam Leitman Bailey, PC, the appellant's counsel, and Newman Ferrara LLP, the respondents' counsel, are directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against them pursuant to 22 NYCRR 1250.2(c) as this Court may deem appropriate, by serving and filing an affirmation or affidavit on that issue, via NYSCEF, on or before December 20, 2024; and it is further,
ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause by uploading a copy of this order to show cause to the NYSCEF system
