DECISION & ORDER ON MOTION

Appeal, by permission, from a decision and order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated May 20, 2022, which determined an appeal from an order of the Civil Court of the City of New York, Kings County, dated July 31, 2019. Motion by the respondent to dismiss the appeal on the ground that the right of direct appeal from the decision and order terminated upon entry in the above-entitled proceeding of a judgment of the Civil Court of the City of New York, Kings County, dated May 23, 2024.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.
