DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Kings County, rendered December 9, 2022. Application by Twyla Carter, Legal Aid Society, on behalf of the appellant for leave to prosecute the appeal as a poor person and for the assignment of counsel, pursuant to Criminal Procedure Law § 380.55(2). Motion by the appellant pro se to withdraw the appeal.

Upon the papers filed in support of the motion and the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion to withdraw the appeal is granted and the appeal is deemed withdrawn; and it is further,

ORDERED that the application is denied as academic.
