Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Genesee County Court, rendered July 26, 2023,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and the notice of appeal dated October 17, 2023, is deemed timely filed and served, and
It is further ORDERED that the notice of appeal filed in the Genesee County Clerk's Office on December 14, 2023, which lists the indictment number as 70139-22 and the date of sentencing as September 5, 2023, shall be treated as valid as to indictment number 70139-22/001 and the sentence date of July 26, 2023, pursuant to CPL 460.10 (6).
