| ORDER TO SHOW CAUSE |
Appeal from an order of the Supreme Court, Kings County, dated September 27, 2022. By decision and order on motion of this Court dated August 19, 2024, paragraph numbers 9 and 10, footnote 3, footnote 4, of the respondents' brief and the material on page 10 of the respondents' brief beginning with the words "The simple fact" and ending with the words "no-fault records" were stricken, and the respondents were directed to serve and file a replacement brief that does not contain the stricken material and is in all other respects the same as the brief previously filed. The respondents have not filed the replacement brief.
Now, on the Court's own motion, it is
ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered striking the brief previously filed by the respondents for failure to comply with the decision and order on motion of this Court dated August 19, 2024, by uploading a digital copy of an affirmation or an affidavit on that issue, via NYSCEF, on or before January 17, 2025; if the respondents be so advised, the respondents may make a motion via NYSCEF, on or before January 17, 2025, for any relief deemed appropriate; and it is further,
ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon the parties by uploading a copy of this order to show cause to the NYSCEF system.
