It is hereby ORDERED that the motion is granted and the appeal from the February 16, 2024 order (which incorporates the appeal from the May 10, 2022 intermediate order) is hereby dismissed, with leave to plaintiff to apply to this Court to vacate the dismissal, pursuant to 22 NYCRR 1250.10 (c).
