Defendant having moved for a writ of error coram nobis seeking leave to file and serve a notice of appeal for a judgment of the Oneida County Court, rendered May 23, 2022,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the notice of appeal dated April 6, 2023 is deemed timely filed, and
It is further ORDERED that Nicholas A. Passalacqua, Esq., is directed to serve the notice of appeal in accordance with CPL 460.10 on or before January 9, 2025.
