DECISION & ORDER ON MOTION
| Kate Klenfner, Ky Jensen Stewart and Abigail Puritz, Petitioners-Respondents, v Abdus Shahid and Halima Ansari, Respondents-Appellants, The Department of Housing Preservation and Development, Respondent-Respondent and Ismene Speliotis as 7A Administrator, Nonparty-Respondent. |
Appeal from an order of the Civil Court of the City of New York, Kings County, dated December 13, 2023.
On the court's own motion, it is
ORDERED that the parties show cause before this court why the appeal should or should not be dismissed on the ground that the appeal was not properly taken in that appellants failed to serve the notice of appeal upon petitioners Kate Klenfner, Ky Jensen Stewart, and Abigail Puritz (see CPLR 5515 [1]) and no application has been made pursuant to CPLR 5520 (a) to cure the defect, by filing an affidavit or affirmation on that issue with the Clerk of this court on or before January 29, 2025; and it is further,
ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on all parties to the proceeding by regular mail.
