Appeal by Shpresim Haxhaj from an order of the Family Court, Westchester County, dated July 27, 2021. By order to show cause dated February 9, 2024, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceedings for failure to comply with a decision and order on motion of this Court dated December 1, 2023, in which the appellant was required to perfect the appeal by January 30, 2024. Motion by the appellant, inter alia, to dispense with third-party service. Separate motion by the appellant, inter alia, to be provided with certain material.
Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion by the appellant, inter alia, to dispense with third-party service and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion by the appellant, inter alia, to be provided with certain material, and the papers filed in opposition thereto, it is
ORDERED that the motions by the appellant are dismissed for failure to pay the motion filing fees (see CPLR 8022[b]); and it is further,
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements.
