DECISION & ORDER ON MOTION

Appeal by Shpresim Haxhaj from an order of the Family Court, Westchester County, dated July 19, 2022. By order to show cause dated March 6, 2024, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal from the order dated July 19, 2022, in the above-entitled proceedings for failure to comply with a scheduling order dated January 12, 2024. Motion by the appellant, inter alia, to dispense with third-party service.

Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion by the appellant and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion by the appellant is dismissed for failure to pay the motion filing fee (see CPLR 8022[b]); and it is further,

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements.
