DECISION & ORDER ON MOTION

Motion by appellant for an extension of time to perfect an appeal from an order of the Civil Court of the City of New York, Kings County, dated January 22, 2024, and pursuant to 22 NYCRR 731.9 (a)(3), for permission to prosecute the appeal on the original record.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion seeking an extension of time to perfect the appeal is granted, and appellant shall perfect the appeal no later than 14 days from the date of this decision and order on motion; and it is further,
ORDERED that in the event the appeal is not perfected within 14 days of the date of this decision and order on motion, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may serve such application upon appellant in person; and it is further,
ORDERED that the branch of the motion seeking to proceed upon the original record is granted and appellant may prosecute the appeal on the original record; and it is further,
ORDERED that appellant shall serve a copy of this order upon the Clerk of the Civil Court of the City of New York, Kings County within 10 days of the date of this order.
No further extensions will be granted.
