The People of the State of New York, Respondent, v John Marky, Appellant.

Motion by appellant to vacate an order of this court dated September 16, 2024, which dismissed an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered February 7, 2024.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is denied with leave to renew by appellant filing with the court an affidavit or affirmation setting forth a reasonable excuse for his default in perfecting the appeal, on or before February 18, 2025.
