DECISION & ORDER ON MOTION

2022-1009 S CR
The People of the State of New York, Respondent, v Armand Retamozzo, Appellant.

Motion by appellant for summary reversal on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency (SCTPVA), rendered September 21, 2022.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED, on the court's own motion, that appellant is directed to request, forthwith, a copy of the electronic recording of the subject proceedings from the clerk of the SCTPVA and use the services of one of the Office of Court Administration-approved transcribers to submit a transcript of the proceedings to the SCTPVA; and it is further,

ORDERED, on the court's own motion, that pursuant to the Uniform District Court Act § 1704, the Rules of the Appellate Terms, Second Department (22 NYCRR) 731.9 (b) (1) and Judiciary Law § 7-a, Lewis A. Silverman is directed to settle the transcript of the proceedings upon presentation to him for settlement, and file a response to the affidavit of errors with the District Court of Suffolk County, Traffic and Parking Violations Agency forthwith; and it is further,

ORDERED that the SCTPVA is directed to serve a copy of this decision and order upon Mr. Silverman within 10 days of the date herein; and it is further,

ORDERED that the court's return shall be transferred to the clerk of this court within 10 days of the filing of the response by Mr. Silverman; and it is further,

ORDERED, on the court's own motion, that the appeal shall be perfected within 120 days of the date of this order.
