| DECISION & ORDER ON MOTION |
Appeal from a trial readiness referee report and order of the Supreme Court, Westchester County, dated September 17, 2024. By order to show cause dated December 13, 2024, the parties were directed to show cause before this Court why the appeal should or should not be dismissed on the ground that the trial readiness referee report and order is not appealable as of right.
Now, upon the order to show cause and no papers having been filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements (see CPLR 5701).
GENOVESI, J.P., BRATHWAITE NELSON, WARHIT and MCCORMACK, JJ., concur.
