| DECISION & ORDER ON MOTION |
Appeal from an oral decision of the Supreme Court, Kings County, issued on April 18, 2024. Motion by the appellant pro se for waiver of costs, fees, and expenses. Application by the appellant to extend the time to perfect the appeal. By order to show cause dated December 16, 2024, the appellant was directed to show cause before this Court why an order should not be made and entered dismissing the appeal on the ground that no appeal lies from an oral ruling and/or that no appeal lies from an unsigned transcript, and the motion and application were held in abeyance in the interim.
Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion by the appellant and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs and disbursements (see CPLR 5701, see Ojeda v Metropolitan Playhouse, Inc., 120 AD2d 717); and it is further,
ORDERED that the motion and the application by the appellant are denied as academic.
