2024-06139, 2024-06142 U.S. Bank National Association, etc., plaintiff-respondent, v Nicole Lawtone-Bowles, appellant, Hudson Valley Federal Credit Union, defendant-respondent. (Index No. 3745/2018)
| DECISION & ORDER ON MOTION |
Appeals from two orders of the Supreme Court, Orange County, both dated July 9, 2024. Motion by the appellant, inter alia, to stay the sale of the subject property, pending hearing and determination of the appeals, to waive certification of the record pursuant to 22 NYCRR 1250.7(g), and for the assignment of counsel. Separate motion by the appellant for waiver of costs, fees, and expenses. Application by the respondent to extend the time to serve and file a brief.
Upon the papers filed in support of the motion to stay the foreclosure sale and the papers filed in opposition thereto, and upon the papers filed in support of the motion for waiver of costs, fees, and expenses and the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, the appeals are dismissed, without costs or disbursements, on the ground that the right of direct appeal from the orders terminated upon entry in the above-entitled action of a judgment of the same court dated January 6, 2025 (see Matter of Aho, 39 NY2d 241); and it is further,
ORDERED that the motions and the application are denied as academic.
BARROS, J.P., CHRISTOPHER, WARHIT and MCCORMACK, JJ., concur.
