DECISION & ORDER ON MOTION

Appeal from a judgment of the County Court, Suffolk County, rendered September 8, 2021. Motion by the appellant, inter alia, in effect, to recall and vacate a decision and order on motion of this Court dated August 12, 2024. Motion by the respondent to enlarge the judgment roll to include a certain document. Separate motion by the respondent to extend the time to serve and file a brief in response to the appellant's pro se supplemental brief.

Upon the papers filed in support of the motion by the appellant and the papers filed in relation thereto, upon the papers filed in support of the motion by the respondent to enlarge the judgment roll to include a certain document and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion by the respondent to extend the time to serve and file a brief in response to appellant's pro se supplemental brief and the papers filed in relation thereto, it is

ORDERED that the motion by the appellant is denied; and it is further,

ORDERED that the motion by the respondent to enlarge the judgment roll to include a certain document is denied; and it is further,

ORDERED that the motion by the respondent to extend the time to serve and file a brief in response to appellant's pro se supplemental brief is granted, and on or before March 21, 2025, the respondent shall serve and file a brief in response to the pro se supplemental brief via NYSCEF, if applicable, or if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
