Appellant having moved to vacate the dismissal of the appeals taken herein from orders of the Supreme Court, Chautauqua County, entered September 8, 2022 and July 23, 2024, and for other relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate the dismissal of the appeal (CA 23-00409) is denied as untimely (see 22 NYCRR 1250.10 [c]), and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal (CA 25-00130) is granted, the time is extended to April 14, 2025, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
