DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Kings County, dated September 27, 2022. By order to show cause dated December 18, 2024, the parties were directed to show cause before this Court why an order should or should not be made and entered striking the brief previously filed by the respondents for failure to comply with the decision and order on motion of this Court dated August 19, 2024, in which the respondents were directed to serve and file a replacement brief on or before September 19, 2024. Motion by the respondents, in effect, to extend the time to comply with the decision and order on motion of this Court dated August 19, 2024.

Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion to strike the brief previously filed by the respondents is denied; and it is further,

ORDERED that the motion by the respondents is granted, the respondents' time to comply with the decision and order on motion of this Court dated August 19, 2024, is extended, and on or before April 7, 2025, the respondents shall serve and file, via NYSCEF, a replacement brief that does not contain the material stricken by the decision and order on motion dated August 19, 2024, and that is in all other respects the same as the brief previously filed.
