Proceeding pursuant to CPLR Article 78. Motion by the respondents pursuant to CPLR 3211(a)(4) to dismiss the petition on the ground that there is another action pending in the Supreme Court, Suffolk County.

ORDERED that the motion is denied; and it is further,
