| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78, inter alia, in the nature of prohibition to prohibit the respondent Kevin J. Kerrigan, a Justice of the Supreme Court, Queens County, from acting in excess of his authority and from presiding over an action entitled Orrego v Morgovsky, pending in that court under Index No. 702511/2023. Application by the petitioner for waiver of costs, fees, and expenses.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application for waiver of costs, fees, and expenses is denied; and it is further,
ORDERED that on the Court's own motion, in the event that the filing fee has not been paid within 120 days from the date of this decision and order on motion, the proceeding shall be dismissed (see CPLR 1101[d]; 8022[b]; 22 NYCRR 1250.17[a][1]).
