DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Nassau County, dated October 23, 2023. Motion by the appellant to waive certification of the record pursuant to 22 NYCRR 1250.7(g), to extend the time to perfect the appeal, for leave to serve and file the record and brief via NYSCEF only, and to dispense with the hard copy filing requirement.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to serve and file the record and brief via NYSCEF only is denied as unnecessary, as the parties have voluntarily participated in e-filing and shall e-file and be served electronically (see 22 NYCRR 1245.5[a]); and it is further,

ORDERED that the branches of the motion which are to waive certification of the record pursuant to 22 NYCRR 1250.7(g), and to dispense with the hard copy filing requirement are granted; and it is further,

ORDERED that the branch of the motion which is to extend the time to perfect the appeal is granted, and on or before April 18, 2025, the appellant shall serve and file the record or appendix and the appellant's brief via NYSCEF.
