| DECISION & ORDER ON MOTION |
Appeal by Administration for Children's Services from an order of the Family Court, Kings County, dated October 17, 2024. Motion by the appellant to stay enforcement of so much of the order as permits the respondent to return to the home where the subject children reside, to continue the release of the subject children to the care and custody of the non-respondent mother with supervision by the appellant, and for the issuance of an order of protection against the respondent in favor of the subject children directing him to stay away from the subject children, except during agency- or approved resource-supervised visitation, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that so much of the order as permitted the respondent to return to the home where the subject children reside is stayed, the subject children are released to the care and custody of the non-respondent mother without supervision by the appellant (see Matter of Sapphire W., _____ AD3d _____, 2025 NY Slip Op 00662), and the respondent shall stay away from the subject children, except during agency- or approved resource-supervised visitation, pending hearing and determination of the appeal, and the motion is otherwise denied.
