Motion by appellant on an appeal from a judgment of conviction of the Justice Court of the Town of Riverhead, Suffolk County, rendered March 14, 2024, to compel the Justice Court to "serve and file" the court's return.
Upon the papers filed in support of the motion and the papers filed in response thereto, it is
ORDERED that the motion is granted, and the Justice Court is directed to file the court's return with this court within 15 days of the date of this decision and order on motion, and to otherwise comply with CPL 460.10 (3) (d); and it is further,
ORDERED, on the court's own motion, that the appeal shall be perfected within 60 days of the date of this order.
