Appeal and cross-appeal from an order of the Supreme Court, Dutchess County, dated August 4, 2023. Application by Beverly Bulay, as personal representative of the estate of Alexander Bulay, Jr., to be substituted for the deceased appellant-respondent Alexander Bulay, Jr., and to amend the caption accordingly. Joint application to withdraw the appeal and cross-appeal.
Upon the papers filed in support of the applications and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application by Beverly Bulay, as personal representative of the estate of Alexander Bulay, Jr., is granted, Beverly Bulay, as personal representative of the estate of Alexander Bulay, Jr., is substituted for the deceased appellant-respondent Alexander Bulay, Jr., and the caption is amended accordingly; and it is further,
ORDERED that the joint application is granted, and the appeal and cross-appeal are deemed withdrawn.
