In the Matter of Anthony J. McNamee,

respondent, v Rosalie I. Vasquez, appellant.

(Docket Nos. V-6634-2020/2024,

V-7742-2020/2024)

DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Suffolk County, dated January 29, 2025. Motion by the appellant, inter alia, in effect, to stay enforcement of the order, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is dismissed for failure to provide proof of service in accordance with the terms of the order to show cause; and it is further,

ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and we decline to grant leave to appeal.

BARROS, J.P., WOOTEN, FORD and HOM, JJ., concur.
