Counsel for appellant having moved to be relieved of assignment on the appeals taken herein from orders of the Family Court, Niagara County, entered October 2, 2023, and October 13, 2023, and respondent-appellant having moved for the assignment of new appellate counsel,
Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,
It is hereby ORDERED that the motion to be relieved of assignment is granted and the appeals are dismissed on the ground that no appeal lies from an order entered upon consent (see Matter of Cherilyn P., 192 AD2d 1084, 1084 [1993], lv denied 82 NY2d 652 [1993]), and
It is further ORDERED that the motion for the assignment of new appellate counsel is dismissed.
