| DECISION & ORDER ON MOTION |
Appeals from an amended order of the Family Court, Rockland County, dated September 23, 2024, and three orders of the same court dated September 24, 2024, September 27, 2024, and October 10, 2024, respectively. By order to show cause dated February 19, 2025, the parties were directed to show cause before this Court why an order should not be made and entered dismissing the appeal from the amended order dated September 23, 2024, in the above-entitled proceedings on the ground that no appeal lies from an order entered upon the default of the appealing party (see CPLR 5511), and dismissing the appeals from the orders dated September 24, 2024, September 27, 2024, and October 10, 2024, in the above-entitled proceedings on the ground that no appeal lies from orders issued ex parte (see CPLR 5701, 5704).
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeals from the
orders dated September 24, 2024, September 27, 2024, and October 10, 2024, in the above-entitled proceedings on the ground that no appeal lies from orders issued ex parte is granted, and the appeals
from the orders dated September 24, 2024, September 27, 2024, and October 10, 2024, are dismissed, without costs or disbursements (see CPLR 5701, 5704); and it is further,
ORDERED that the branch of the motion which is to dismiss the appeal from the amended order dated September 23, 2024, is held in abeyance and referred to the panel of Justices hearing that appeal for determination upon the argument or submission thereof.
