DECISION & ORDER ON MOTION

Ana Reguera Rodriguez and Victor Garcia, Respondents, v Roni Abudi and 231 Stanhope 2016, LLC, Appellants.

Motion by respondents to dismiss an appeal from an order of the Civil Court of the City of New York, Kings County, dated May 23, 2024.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that the appeal is stricken from the appeals calendar on the ground that the appeal has not been properly perfected in that the pleadings have not been made part of the record; and the reproduced record, appellants' brief and respondents' brief shall be returned, and it is further,

ORDERED that on the court's own motion, the appellant is granted an extension of time to perfect the appeal, and appellants shall perfect the appeal, by re-serving and re-filing a corrected reproduced record and an appellant's brief on or before June 9, 2025; and it is further,

ORDERED that in the event the appeal is not perfected by June 9, 2025, the court, on its own motion, may dismiss the appeal, or respondents may move to dismiss the appeal on three days' notice and may serve such motion upon appellants in person.
