DECISION & ORDER ON MOTION

2023-1052 S CR
The People of the State of New York, Respondent, v Bryan Gershen, Appellant.

Motion by appellant for an extension of time to perfect an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered June 20, 2023, and to compel the Agency to file a return with this court.

Upon the papers filed in support of the motion and the papers filed in opposition to so much of the motion to compel the agency to file a return with the court, it is

ORDERED that the branch of the motion seeking an extension of time to perfect the appeal is granted, and the appeal shall be perfected on or before June 30, 2025; and it is further,

ORDERED that in the event the appeal is not perfected by June 30, 2025, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may, if the appellant is unrepresented, serve such motion upon appellant in person, and it is further,

ORDERED that the branch of the motion seeking to compel the Agency to file a return with this court is denied without prejudice to renew after the filing by appellant of an Affidavit of Errors with the Agency pursuant to CPL § 460.10 (3) (a).

No further extensions will be granted.
