Appellant having moved for permission to proceed as a poor person and for other relief, on the appeal taken herein from an order of the Supreme Court, Oneida County, entered February 10, 2025,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks poor person relief is granted, and
It is further ORDERED that the Oneida County Clerk provide Mental Hygiene Legal Services with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and
It is further ORDERED that the motion insofar as it seeks to seal the record and papers filed on this appeal is granted, and
It is further ORDERED that the motion insofar as it seeks to proceed anonymously is granted, and
It is further ORDERED that the motion insofar as it seeks assignment of appellate counsel other than Mental Hygiene Legal Services is denied.
Memorandum: Even assuming, arguendo, that the potential conflict of interest raised in the motion required disqualification of the entire agency (see generally People v Pica-Torres, 227 AD3d 1127, 1128-1129 [3d Dept 2024]), the assignment of appellate counsel other than Mental Hygiene Legal Service is not available.
