Appellants having moved to substitute Patsy D. Putnam as Executor of the Estate of Darwin L. Putnam as a party to the appeal and moved to vacate the dismissal of the appeal (denominated motion for an extension of time to perfect) taken herein from an order of the Supreme Court, Herkimer County, entered July 5, 2024,
Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,
It is hereby ORDERED that the motion to substitute Patsy D. Putnam, as executor of the Estate of Darwin L. Putnam, deceased, is granted and the caption of the appeal is hereby amended accordingly, and,
It is further ORDERED that the motion insofar as it seeks to vacate dismissal of the appeal is granted on the condition that the appeal is perfected on or before June 20, 2025.
