DECISION & ORDER ON MOTION
| Lue Inez Fryar, Appellant, v Susan Recchia, Respondent. |
Appeal from the "notes" of a Judge of the City Court of Poughkeepsie, Dutchess County, dated March 5, 2024.
On the court's own motion it is
ORDERED that the appeal is dismissed.
The appeal must be dismissed as no appeal lies from a judge's notes (see CPLR 5512 [a]; UCCA 1702; cf Dorizas v Island Insulation Corp., 254 AD2d 246 [ 2nd Dept 1998]; Ojeda v Metropolitan Playhouse, 120 AD2d 717 [ 2nd Dept 1986]; Matter of Godfrey v Suffolk County-Town of Smithtown 10th Judicial, Motion No. 2023-10031[2nd Department 2023]), and there is no order from which to appeal (CPLR 2219).
